category Regional, chandigarh, , tags Regional, chandigarh, , DW BUREAU Chandigarh The Haryana Cabinet which met under the chairmanship of Chief Minister Manohar Lal hereon Wednesday, has approved a comprehensive policy aimed at regularizing unauthorized constructions and granting fresh permissions for constructing the first floor or basement or both on single-level booths, shops, and service booths allotted by municipalities or Town Improvement Trusts within municipal limits. The Chief Minister Manohar Lal revealed that this policy extends its reach to encompass all municipalities across the state of Haryana. It specifically applies to single-level booths, shops, and service booths allocated by municipalities or Town Improvement Trusts. The policy facilitates the regularization of existing unauthorized constructions, including basements and first floors, and grants fresh permissions for such constructions. For the regularization of existing unauthorized construction of the first floor or basement or both on the booth, the policy remains in effect for applications received until March 31, 2024. Fresh permissions for constructing the first floor or basement or booth are not bound by any time limit. Significantly, this policy does not apply to controlled areas requiring Change of Land Use (CLU) permission. It also excludes licensed schemes sanctioned by the Town and Country Planning Department within municipal limits. Furthermore, the policy excludes shops under tehbazari or khoka or any other temporary structures allotted by municipalities. Applicants aiming to regularize illegal constructions or construct first floors or basements on single-level booths, shops, or service booths must adhere to this policy. The competent authorities responsible for processing applications are the Commissioners for Municipal Corporations and the District Municipal Commissioners for Municipal Councils and Committees. The fee structure under this policy includes a non-refundable scrutiny fee that varies based on the nature of the construction. For fresh permissions covering the first floor, basement, or both, applicants will be charged Rs 10 per square meter on the proposed total built-up area. Conversely, for regularization of existing first-floor or basement constructions, the fee remains at Rs 10 per square meter but applies to both the proposed and existing built-up area on the plot, including the structure at the ground floor. Additionally, charges for any additional built-up areas, whether it s the first floor or basement, differ further: 5 of the commercial collector rate per square meter for the first floor and 2.5 of the commercial collector rate per square meter for the basement. Furthermore, a Composition Charge of Rs. 200 per square meter is in place to compound illegal construction within the defined compoundable limits. In adherence to the building norms stipulated by this policy, existing first-floor or basement constructions will be permitted without alteration. However, for fresh permissions related to first-floor or basement construction, specific guidelines are set in place: basement construction is confined to the dimensions of the booth corridor on the ground floor, while first-floor construction is allowed within predetermined limits, supplemented by provisions tailored to the booth s characteristics. A minimum clear height of 2.4 meters is mandated for both basements and first floors. Additionally, staircases for accessing basements or the first floor are required to be contained within the booth, and stringent regulations prohibit any form of encroachment on corridors, rear spaces, or sides of booths. Municipalities will identify and list illegally raised constructions on single-level booths, shops, or service booths from property ID databases. Notices will be issued to owners of such constructions, directing them to submit applications for regularization. Applicants will submit applications online, ensuring compliance with specified documents and scrutiny fees. Competent authorities will process applications within 20 working days. Ineligible applications will receive a Letter of Intent (LoI) with a compliance deadline of 30 days.
